The appellate judges gave the green light to the Retired Detroit Police Members Association’s appeal on the eligibility of Detroit’s bankruptcy filing. The appeal was entered on the association’s behalf by Strobl & Sharp, P.C. attorneys Lynn Brimer, Meredith Taunt and Mallory Field. The hearing, scheduled to take place July 30 in the Sixth Circuit Court of Appeals in Cincinnati, has been withdrawn pending a settlement with the City.
The basis of the appeal was that the Michigan’s emergency manager law is unconstitutional because it is quite similar to a previous law repealed in 2012.
In two weeks, the bankruptcy court in Detroit will start hearing the Plan of Adjustment.
