Area of law that determines whether an individual is an alien. It ascertains the rights and obligations of aliens in the United States. It provides the means to obtain citizenship or permanent residency for certain aliens. It ascertains who is permitted to enter the United States, the length of the person’s stay and determines when the person is required to leave. Permanent residency can now be obtained through the use of an EB-5 Fifth Preference – Employment Based Visa. The EB-5 investment visa requires an investment of $500,000 into a government regional center. An EB-5 visa recipient may apply for citizenship five years after receiving the EB-5 visa.
